Terms of Use – "Bourloto" App

1. Acceptance of Terms

These Terms of Use (the "Terms") govern access to and use of the mobile application "Bourloto" (the "App") and related online services (e.g. creating/joining rooms, APIs) provided in connection with the App.
By installing, launching, or continuing to use the App, you confirm that you have read, understood, and unconditionally accept these Terms. If you do not agree, please do not use the App.
Use of the App is also subject to the Privacy Policy (available at bourloto.com/privacy or an equivalent URL), which explains how we process personal data.

2. Nature of the Service

The App is offered for entertainment only. It is a multiplayer trivia/question game and related features (including, for example, game rooms, rounds, scoring, and other game modes that may be added).
It is not gambling with real money, betting, or claiming monetary prizes from us. Any "win" or score is virtual/entertainment and has no cash value.

3. Eligibility and Minimum Age

The App is intended for users who can enter a legally binding agreement under the law of their country. Where applicable law sets a minimum age for such services or for parental/guardian consent, the user represents that they meet those requirements.
If you are a parent or guardian allowing a minor to use the App, you are responsible for their use and compliance with these Terms.

4. Account, Player Name, and Rooms

Some features may require registration or identification (e.g. player name, device identifier, or an account through a third-party provider such as Firebase/Google, where applicable).
You are responsible for the accuracy of information you provide and for keeping your credentials confidential, to the extent they exist.
You may not use a player name that infringes third-party rights, is misleading, suggests an official relationship with us without permission, or contains abusive, racist, sexual, violent, or illegal content.
The room creator/host may have additional duties in-game (e.g. starting rounds); joining a room means you accept the rules of that game mode as implemented in the App.

5. Acceptable Use and Prohibited Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. Prohibited conduct includes, for example:
• attempting to bypass security, modify code, reverse engineer, or decompile the App, except where expressly permitted by law;
• using bots, scripts, or automated means to abuse APIs or services;
• distributing malware, spam, or content that harms other users or infrastructure;
• harassing, threatening, stalking, or intimidating other players;
• submitting answers or other content that infringes third-party rights or is illegal;
• using the App in a way that violates Apple App Store or Google Play terms where the App is distributed.

6. User Content and Visibility

During play, certain items (e.g. player name, answers, score) may be visible to other participants in the same room or on related screens.
You are solely responsible for content you submit. We do not proactively review all user content; we reserve the right, without obligation, to remove content or restrict access in case of a Terms violation or legal duty.

7. Advertising, In-App Purchases, and Third Parties

The App may display ads (e.g. via Google AdMob). Advertisers and ad providers are subject to their own policies.
Third-party services may be used for analytics, error reporting, push notifications, backend hosting, and subscription/in-app purchase management (e.g. Google/Firebase, RevenueCat). Use of such services is governed by those providers' terms.
Personal data processing is governed by the Privacy Policy.

7.1. Subscriptions and In-App Purchases

The App may offer optional in-app purchases, such as non-renewing purchases (e.g. lifetime) and auto-renewing subscriptions (e.g. monthly), as shown in the App Store, Google Play, and the App at the time of purchase. Prices, duration, billing per period, and any offers (including free trials or introductory pricing, where offered) are determined by the specific store product; check the purchase screen before confirming.
• Payment is charged to your Apple ID account (iOS) or Google Play account (Android) upon confirmation. We do not process or store your full card or payment method details; payment processing is handled by Apple or Google under their policies.
• Auto-renewing subscriptions renew automatically unless you turn off auto-renewal at least 24 hours before the end of the current billing period.
• Your App Store or Google Play account may be charged for renewal within 24 hours before the current period ends, at the then-current price of the selected plan.
• Managing subscriptions and turning off auto-renewal is done by you through your App Store or Google Play account settings (e.g. iOS: Settings > [Apple ID] > Subscriptions; Android: Google Play > Profile > Payments & subscriptions > Subscriptions), per Apple and Google instructions on your device.
• Where a free trial or introductory offer is available, any unused portion may be forfeited when a paid subscription starts or when the purchase completes, as defined by the platform; check product details before purchase.
• Restore purchases: If you reinstall the App or change devices, you may use "Restore Purchases" in the App (where available) with the same store account (Apple ID / Google) used for the original purchase.
• Refund requests, charge cancellations, and payment disputes are governed by Apple or Google policies and procedures; contact the relevant platform for such matters.
• In-app transactions are also subject to the Apple App Store and Google Play terms and policies that apply to you.

Definition of “Lifetime Access” purchase:

Where a “lifetime” purchase option (Lifetime Access / non-consumable IAP) is offered, it grants access to the corresponding premium App features for as long as the App remains active, available, and supported by us. “Lifetime” refers to the lifetime of the product/service (Product Lifetime), not the user’s lifetime. If the App is permanently discontinued or withdrawn (Sunsetting), that access ends as set out in Section 8.

8. Availability, Changes, Termination, and Sunsetting

We strive to provide stable operation, but the App and servers may not always be available (maintenance, outages, force majeure, infrastructure changes).
We may modify, suspend, or discontinue the App or features, in whole or in part, temporarily or permanently, with or without notice.
If we decide to permanently discontinue the App (Sunsetting):
• We will make reasonable efforts to notify users in advance (e.g. in-app notice, our website, or email) within a reasonable period before the termination date.
• After the termination date, access to online services (rooms, servers, backend) and purchased features (including subscriptions and Lifetime access) may cease permanently.
• Discontinuing the App does not create an obligation to compensate or refund past purchases beyond what is mandatorily required by Apple App Store and Google Play refund policies or applicable mandatory consumer protection law.
Rooms, scores, statistics, and game data may be deleted or not retained indefinitely.

9. Intellectual Property

All rights in the software, graphics, branding, question texts (where owned by us), music/sounds, and other App materials belong to us or our licensors, unless stated otherwise.
Copying, modifying, selling, leasing, redistributing, or exploiting materials without prior written permission is prohibited to the extent allowed by law.

10. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available" without express or implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses/harmful content.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, special, exemplary, or consequential damages, including loss of profits, data, goodwill, or business interruption, arising from or related to use or inability to use the App.
In any case, our total liability for claims arising from or related to the App is limited to the amount you paid us directly for the App in the preceding twelve (12) months, or zero if nothing was paid—except where law prohibits such limitation (e.g. fraud or gross negligence as defined by applicable law).

12. Indemnification

You agree to indemnify and defend us against third-party claims arising from your use of the App, violation of these Terms, or content you submit, to the extent permitted by law.

13. End of Use

We may suspend or terminate your access if we believe you violate these Terms, laws, or others' rights, or for security and operational reasons.
You may stop using the App at any time by uninstalling it; certain provisions (e.g. limitation of liability, intellectual property) survive termination.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Hellenic Republic, without regard to conflict-of-law rules, except where mandatory provisions of EU law or your country of residence as a consumer require otherwise.
For consumers in the EU, you may have the right to use out-of-court dispute resolution mechanisms under applicable law.

15. Changes to Terms

We may update these Terms. We will update the "Last updated" date and, where required, provide additional notice (e.g. in-app). Continued use after material changes may constitute acceptance, unless law requires a different process.

16. Severability

If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
